The Biden administration has asked the US Supreme Court to take up a major abortion pill case that could limit access to the drug early in pregnancy.
The case involves a challenge to a Trump-era rule issued by the Food and Drug Administration requiring women seeking to end a pregnancy to us the abortion pill in-person at a clinic, hospital or doctor’s office.
The American College of Obstetricians and Gynecologists and several states have argued that the rule is medically unnecessary and would impose a significant and unconstitutional burden on women seeking abortions.
The Biden administration has asked the Supreme Court to toss out the case in light of the new administration’s policy of easing restrictions on abortion access. The administration’s filing did not, however, address the merits of the challenge to the rule itself.
The Supreme Court is expected to decide whether to take up the case later this year.
