Why Is Dunamu Facing Regulatory Action?

South Korea’s Financial Supervisory Service has reportedly sent an inspection opinion letter to Dunamu, the operator of crypto exchange Upbit, over a $36 million hack that hit the platform in November 2025.

The letter formally starts the sanctions process by financial authorities. It gives Dunamu a chance to respond to the inspection findings before the regulator issues a notice outlining any proposed penalties or corrective measures.

The case centers on how Upbit handled the breach, including the timing of its public disclosure. The hack began at 4:42 a.m. Korea Standard Time on November 27 and lasted about 54 minutes. Upbit did not announce the incident until later that day, after a merger-related event involving Naver Financial had concluded.

That delay has become a key point of scrutiny. For regulators, the issue is not only whether the exchange was hacked, but whether users were informed quickly enough and whether internal controls were strong enough for a platform handling large volumes of digital assets.

What Legal Gap Is The Regulator Reviewing?

The Financial Supervisory Service is reviewing whether Upbit violated South Korea’s Virtual Asset User Protection Act. The problem for authorities is that the law does not contain direct sanctions provisions for cyberattacks, computer hacks, or related system failures.

That gap makes the case important beyond Dunamu. South Korea has already introduced a stronger user protection framework for crypto markets, but the Upbit hack shows where enforcement tools remain incomplete. A cyber incident can impose direct losses on users and damage market confidence, yet the current law may not give regulators a clear path to penalize platforms solely because of the hack itself.

Authorities are expected to address that weakness in the second phase of the Digital Asset Basic Act. Planned additions include sanctions and compensation provisions for hacking incidents and computer system failures. If adopted, those changes would give regulators broader powers to respond when exchanges suffer security breaches or operational failures that affect users.

The Dunamu case shows how crypto enforcement is moving from licensing and investor warnings toward operational resilience. For large exchanges, cybersecurity failures are becoming regulatory events, not only technology incidents.

How Did Upbit Respond After The Hack?

Upbit said after the November exploit that it froze about 2.3 billion won, or roughly $1.5 million, worth of funds. The exchange also said it would fully reimburse affected customers using its own balance sheet assets.

The reimbursement helped limit direct user losses, but it does not remove the regulatory question. Authorities are likely to focus on breach management, wallet controls, disclosure timing, and whether the exchange had sufficient safeguards before the exploit occurred.

Upbit said it began overhauling its crypto wallet architecture after the incident and moved all assets from affected wallets. The exchange later said it had developed an automatic onchain tracking service, called Onchain AI Tracer System, to trace stolen funds and support possible recovery efforts.

Those steps point to a more defensive operating model for major exchanges. Wallet design, asset segregation, onchain monitoring, and incident response are now central to how regulators assess exchange risk. In markets where retail participation is high, a fast reimbursement policy may help protect users, but regulators are increasingly looking for proof that the original control environment was strong enough.

What Are The Market Implications For Korean Exchanges?

Upbit remains one of the largest crypto exchanges in South Korea and ranks among the major global spot trading platforms by liquidity, traffic, and volume metrics. Regulatory action against its operator would therefore carry broader market weight.

For exchanges, the immediate implication is higher compliance pressure around cybersecurity, disclosure, and user compensation. Platforms may need to show stronger wallet controls, clearer incident escalation procedures, and faster public communication when breaches occur.

For investors, the case highlights the difference between trading volume and platform risk. A large exchange can still face regulatory exposure if authorities decide that user protection standards were not met. That risk becomes more important as South Korea prepares the next phase of its digital asset framework.

The sanctions process does not mean a final penalty has been decided. Dunamu will be able to respond before regulators notify the company of proposed sanctions. Still, the inspection letter moves the case into a formal enforcement track and places Upbit’s security practices under closer review at a time when South Korea is tightening its crypto rulebook.
